Notary Public Services

A Pennsylvania notary public is a public official, appointed by the Pennsylvania Department of State, who serves as an impartial witness to deter fraud by verifying the identity of document signers and witnessing their signatures on important documents. Key duties include administering oaths and affirmations, taking acknowledgments and verifications, certifying document copies, and attesting to signatures. Notaries are required to pass an examination, complete a mandatory educational course, and maintain a clean record to qualify for their four-year commission.  

Key Responsibilities

  • Verifying Identity: Confirming the identity of the individual signing a document, typically by checking a photo ID. 

  • Administering Oaths/Affirmations: Formally administering oaths and affirmations to individuals as part of legal or official processes. 

  • Taking Acknowledgments: Witnessing a signer's signature on a document and verifying their identity and willingness to sign it. 

  • Certifying Copies: Creating certified copies of documents to ensure their authenticity. 

  • Witnessing Signatures: Serving as an impartial witness to the act of a document being signed. 

Authorized Agent (PennDOT)

  • Give Legal Advice:

    Notaries are not authorized to provide legal advice, explain documents to a signer, or tell them what to say.

  • Draft Legal Documents:

    They are not permitted to draft legal documents, such as wills, deeds, or contracts.

What a Notary Cannot do:

A "PennDOT notary" is a notary public authorized to perform notarial acts, such as witnessing signatures on motor vehicle forms, but for certain specific functions, they must also be an authorized messenger or agent services. While a standard notary can verify identities on vehicle paperwork, only an authorized agent can transfer plates, issue temporary plates, or perform certain online transactions for the Department of Motor Vehicles (DMV). Authorized agents also enter into a contract with PennDOT and complete specific training, in addition to their notary commission.  

Key Responsibilities

  • Authorized Agent (or Messenger):

    An individual or business with a specific contract with PennDOT to provide more complex motor vehicle services. 

    • This status allows agents to issue temporary registration plates and handle certain other transactions that a regular notary cannot. 

    • Agents must undergo specific training and adhere to PennDOT's business standards.
